These Terms of Use (“Terms”) govern access to and use of the Open Prop Market website and related services (the “Platform”). By creating an account, posting a listing, sending an enquiry, or otherwise using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.
1. Who we are
Open Prop Market is an online marketplace that displays property listings submitted by users (owners, brokers, agents, builders and buyers). We provide software tools to publish listings and exchange enquiries. We are not a real-estate brokerage, escrow agent, lender, lawyer, or title company unless separately stated in writing.
2. Eligibility & accounts
You must be legally able to enter a binding contract in your jurisdiction. You are responsible for keeping login credentials confidential and for all activity under your account. Provide accurate profile information. Email verification may be required before listing. Administrators may be exempt from certain verification steps for operational reasons.
3. Listings & user content
You retain ownership of content you submit, but grant Open Prop Market a worldwide, non-exclusive, royalty-free licence to host, display, reproduce and distribute that content for operating and promoting the Platform. You represent that you have all rights needed to publish the listing (including photos/video) and that information is accurate and not misleading.
You must not post illegal content, discriminatory housing ads (where prohibited by law), fraudulent offers, spam, malware, or content that infringes others’ rights. Listings may be reviewed, edited, unpublished or removed at our discretion. Submission does not guarantee publication.
4. No agency; transactions are between users
Any sale, rent, lease or other transaction is solely between the parties involved. Open Prop Market does not verify title, ownership, zoning, occupancy, pricing, or the identity of every user beyond tools we choose to offer (such as email verification). Always conduct your own due diligence, site visits and professional advice before paying deposits or signing contracts.
5. Enquiries & communications
Enquiry forms may share your name, email, phone and message with the listing contact. Do not use enquiries for harassment, scams or unsolicited marketing. We may rate-limit or block abusive behaviour.
6. Membership & fees
Some listing quotas or features may require a paid membership arranged offline or via contact. Fees, if any, will be confirmed before you pay. Unless required by law, fees are non-refundable once services are provisioned. We may change plans with reasonable notice.
7. Acceptable use
You may not scrape the Platform at scale, attempt to bypass security controls, probe vulnerabilities, overload systems, impersonate others, or use automated means to create accounts or send verification-code / enquiry spam.
8. Intellectual property
The Open Prop Market name, logos, design and software are protected. You may not copy or reuse our branding or code without prior written permission.
9. Disclaimers
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free service, or that listings are complete, current or accurate.
10. Limitation of liability
To the maximum extent permitted by law, Open Prop Market and its operators shall not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or business opportunities arising from use of the Platform or reliance on listings. Our aggregate liability for any claim relating to the Platform shall not exceed the greater of (a) fees you paid us for the service giving rise to the claim in the 3 months prior, or (b) USD 50.
11. Indemnity
You agree to indemnify and hold harmless Open Prop Market from claims arising out of your listings, enquiries, misuse of the Platform, or violation of these Terms or applicable law.
12. Suspension & termination
We may suspend or terminate accounts that violate these Terms or create legal or security risk. You may stop using the Platform at any time. Provisions that by nature should survive (including IP, disclaimers, liability limits and indemnity) will survive termination.
13. Governing law
These Terms are governed by the laws applicable at the primary place of business of the Platform operator, without regard to conflict-of-law rules, except where mandatory consumer protections in your country apply. Courts in that jurisdiction shall have exclusive venue, subject to those mandatory rights.
14. Changes
We may update these Terms by posting a revised version on this page. Continued use after changes constitutes acceptance of the updated Terms.
